This post is in continuation to my previous article on how HDFC Bank forged my signature and changed application form!
After more than 15 days of initial complaint HDFC Bank has responded. They say changing application form and forging signature is a human error!
From the response I infer that they are accepting that they forged my signature and changed the application form. I was dealing with HDFC as a financial institution and hence HDFC is fully responsible for actions of their employee. They are smartly trying to avoid the word “forgery” in the response. Forging a signature is never an error but intentional.
They say there is no financial loss after debiting my account with charges(reversed after complaint) and also gaining the print/courier charges of sending physical statement.
Further they are asking my consent to close my credit card account.This re-iterates their mistake again. I guess legally since they have issued a card with forged signature I would not be liable to pay the dues 🙂

Hi Sandeep… Really sad state of affairs… Also it was great work from you… Your systematic approach has greatly helped you here… I’ve learnt alot… Thanks for sharing… I assume that closing your card will ensure that the entire episode is laid to rest… As dar a small your credit card dues go… I would have insisted on a compensation… This is a ofence that is totally unlawful… You may name it what you want error, mistake oversight… But its plain old 420…I would also like for you to push the banks into letting the public know what steps have been in initiated to avoid this from happening to anyone else…

A consumer forum complaint will be the simpler way to take this forward. The forum can initiate a criminal complaint if the conclude it is forgery

Hi Sandeep…Debit card thing also happened with me. By default I was issued premium debit card and Rs 590 was deducted. I had applied for regular saving account through my office. When I took the matter to BM,he kept pressuring me to visit branch for any query. After I lodged my complaint online BM accepted fault and agreed to reverse the amount. Amount was reversed in a week. But in my case GST of Rs 90 was deducted. Only Rs 500 was reversed.

Sorry to hear that you faced same issue of debit card charges. As you can see in the screenshot posted, they have refunded me full amount in debit card case.
Always make written complaints(email is easy). You can probably raise a complaint with RBI Banking ombudsman now also to get the remaining amount back. Its online and easy http://cms.rbi.org.in (although resolution may take several months).
